1. Introduction
This Copyright & Intellectual Property Policy explains the ownership, permitted use, protection and enforcement of intellectual-property rights relating to Optraction, a product owned and operated by Concept Colony Limited (registration number 9087914). It should be read together with our Terms & Conditions and Privacy Policy.
2. Definitions
- IP Rights — intellectual-property rights including patents, trademarks, service marks, trade names, design rights, copyright and database rights.
- Optraction Materials — the software, databases, visual interfaces, branding and documentation provided as part of the Service.
- User Content — information, files, documents or other materials created, uploaded, submitted, shared or stored by a user through the Service.
3. Ownership of the Platform
Optraction and all of its components, including but not limited to its source code, visual design, user interfaces, and proprietary data-processing methods, are and remain the exclusive property of Concept Colony Limited. No ownership rights in the Optraction Materials are transferred to users through their use of the Service or the purchase of a subscription or licence. All rights not expressly granted are reserved.
4. User-Generated Content
Concept Colony Limited acknowledges that all IP Rights in User Content remain the property of the user or their respective owners. However, by uploading, submitting or sharing content, you grant us the rights described below:
4.1 Processing Licence
A limited, non-exclusive licence to host, store, process, transmit and display your User Content as reasonably necessary to provide and support the Service and to enable the collaboration and sharing you direct.
4.2 Aggregated Analytics
The right to use de-identified and aggregated data — which cannot reasonably be used to identify you — for product improvement, security and reporting purposes, consistent with our Privacy Policy.
You represent and warrant that you own or have the necessary rights and lawful basis to upload and share your User Content and to grant the licences above.
5. Permitted Use and Restrictions
Subject to your compliance with the Terms, you are granted a limited, non-exclusive, non-transferable right to access and use the Optraction Materials for their intended purpose. You must not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Optraction Materials except to the extent expressly permitted by law or by us in writing.
6. Trademarks
"Optraction", the Optraction logo, and related names and marks are trademarks of Concept Colony Limited. You may not use them without our prior written permission, except to refer factually to the Service in a manner that is not misleading and does not imply endorsement.
7. Enforcement and Infringement
We respect the intellectual-property rights of others and expect users to do the same. Unauthorised use of the Optraction Materials — including reverse engineering, scraping or copying for the purpose of creating a derivative product — will result in immediate termination of access and may lead to legal action.
Reporting infringement
If you believe content on the platform infringes your intellectual-property rights, please follow the notice procedure in the next section.
8. Reporting an Infringement (Takedown Notice)
To report content you believe infringes your IP Rights, send a written notice to [email protected] including:
- Your name and contact details;
- Identification of the work or right you claim has been infringed;
- Identification of the allegedly infringing content and its location on the Service;
- A statement that you have a good-faith belief the use is not authorised by the rights holder, its agent or the law;
- A statement that the information in your notice is accurate and that you are the rights holder or authorised to act on its behalf;
- Your signature (electronic or physical).
We will review valid notices and may remove or disable access to the content, notify the user who posted it, and take further action where appropriate. We may also provide the affected user an opportunity to respond. Repeat infringers may have their access terminated.
9. Changes to This Policy
We may update this Policy to reflect changes to the Service or legal requirements. The revised version will display an updated date.
